Welcome to Amalean LLC. By accessing our website and purchasing our services whether online or in-store, you agree to comply with the following Terms and Conditions. By booking an appointment with us, you agree to comply with the following Terms and Conditions. 

1. General Terms

1.1 These Terms and Conditions govern all sales and services provided by Amalean LLC (“we,” “us,” “our”) to the customer (“you,” “your”). 1.2 We reserve the right to modify these terms at any time. Your continued use of our services constitutes acceptance of any updates.

2. Custom Orders & Fittings

2.1 All garments are made from scratch based on your measurements and specifications. Once production begins, changes and refunds cannot be made. 2.2 We are not responsible for measurement errors provided by the client (if provided). If measurements are taken by our team, we allow for adjustments if deemed necessary. 2.3 Alterations due to fit preferences after 24 hours of garment delivery are at the client’s expense unless otherwise specified. 2.4 Clients are responsible for reviewing and confirming all fabric & material choices, and customization options before production begins.

3. Payment & Pricing

3.1 A 66% non-refundable minimum deposit is required to initiate any first-time bespoke order, with the remaining balance due upon first fitting and/or prior to final delivery. 3.2 A full payment is required to initiate any bespoke order (excluding first-time) or Made to Measure Order. 3.3 Prices are subject to change without notice; however, confirmed orders will not be affected.

4. Refunds & Cancellations

4.1 Due to the custom nature of our garments, all sales are final. We do not offer refunds or exchanges. 4.2 After production has begun, no cancellations will be accepted. 4.3 We can accommodate minor alterations upon final delivery to meet client preferences.  4.4 Minor alterations would include a maximum of $150 of changes deemed necessary by the fitter. 

5. Production & Delivery Timeframes

5.1 Estimated production timeframes will be provided at the time of purchase. While we strive to meet deadlines, production delays due to fabric availability, supply chain issues, or unforeseen circumstances may occur. 5.2 We are not responsible for delays outside our control, including force majeure events such as natural disasters, pandemics, or labor strikes. 5.3 Clients will be notified of any significant delays and offered alternative solutions where possible.

6. Limitation of Liability

6.1 Amalean LLC is not liable for any indirect, incidental, or consequential damages resulting from the use of our services or garments. 6.2 Our liability shall not exceed the amount paid by the customer for the order in question. 6.3 By purchasing from us, you waive any right to pursue legal action against Amalean LLC for dissatisfaction related to fit, styling, or personal preference.

7. Shipping & Delivery

7.1 We ship domestically and internationally. Shipping costs vary based on location and service level. 7.2 We are not responsible for delays caused by third-party carriers or customs. 7.3 Risk of loss transfers to the customer upon shipment.

8. Force Majeure

8.1 We shall not be held liable for delays or failures in performance due to circumstances beyond our control, including but not limited to natural disasters, acts of war, pandemics, or government restrictions.

9. Dispute Resolution

9.1 Any disputes arising from or related to our services shall be settled by binding arbitration in Miami, Florida, in accordance with applicable arbitration law.  9.2 By agreeing to use our services, you agree to waive your right to file a lawsuit against us and you waive your rights to a trial by jury.  9.3 All disputes shall be resolved by binding arbitration and each party shall bear their respective costs associated with an arbitration resolution and shall bear their own attorney’s fees if a party elects to be represented by an attorney. 

10. Intellectual Property

10.1 All content, designs, and branding associated with Amalean LLC are our intellectual property and may not be used without permission.

11. Privacy Policy

11.1 We collect and store customer information solely for the purpose of fulfilling orders and providing customer support. Your information will not be shared or sold to third parties. 11.2 By using our services, you agree to the terms of our Privacy Policy.

12. Governing Law

12.1 These Terms and Conditions shall be governed by and construed under the laws of Florida in the United States of America and venue is limited to Miami-Dade County Florida.

13. In-Store Policy

13.1 Customers and visitors are expected to conduct themselves in a respectful manner while on the premises of Amalean LLC. 13.2 Disruptive, abusive, or inappropriate behavior towards staff or other customers will not be tolerated and may result in refusal of service and/or removal from the premises. 13.3 The use of photography, videography, or recording devices inside or outside the premises is strictly prohibited without prior written consent from Amalean LLC. 13.4 By entering our store, you waive the right to use photography, videography, or recording devices and waive any right to take legal action regarding the enforcement of this policy.
